Being charged with assault in Minnesota can result in a felony, gross misdemeanor, or misdemeanor charge. These serious charges may result in prison or jail time, fines and restitution payments to the victim. Other consequences may include counseling, parole / probation and a permanent criminal record. A criminal record may prevent you from owning a firearm, cause you to lose your job, make it difficult or impossible to obtain housing, make it difficult or impossible to enroll in higher education or vocational training programs, and create negative perceptions toward you among your family, friends, and the community.

Minnesota statutes contain six types of assault crimes, including:

1st degree assault

Minnesota law provides that whoever assaults another person and inflicts great bodily harm is guilty of First Degree Assault.

Great Bodily Harm means bodily harm that creates a high probability of death, causes serious permanent disfigurement, or causes a permanent or protracted loss or impairment of the function of any part of the body.

2nd degree assault

Minnesota provides that whoever assaults another person with a dangerous weapon is guilty of Assault in the Second Degree.

It also provides that whoever assaults another with a dangerous weapon and inflicts substantial bodily harm is guilty of Assault in the Second Degree.

A firearm, whether loaded or unloaded, or even temporarily inoperable, is a dangerous weapon.

A Dangerous Weapon is anything designed as a weapon and capable of producing death or great bodily harm, or any combustible or flammable liquid or anything else that, in the manner it is used or intended to be used, is known to be capable of producing death or great bodily harm or any fire that is used to produce death or great bodily harm.

Substantial Bodily Harm means bodily harm that involves a temporary but substantial disfigurement, causes a temporary but substantial loss or impairment of the function of any bodily member or organ, or causes a fracture of any bodily member.

3rd degree assault

Minnesota provides that whoever assaults another and inflicts substantial bodily harm is guilty of Third Degree Assault.

Minnesota also provides that whoever assaults a minor and has engaged in a past pattern of child abuse against the minor is guilty of Third Degree Assault.

Moreover, Minnesota provides that whoever assaults a child who is under the age of four and causes bodily harm to the child's head, eyes, or neck or otherwise causes multiple bruises to the body is guilty of Third Degree Assault.

4th degree assault

Fourth Degree Assault relates to whoever assaults a licensed peace officer when that officer is effecting a lawful arrest or executing any other duty imposed by law.

You may also be prosecuted for Assault in the Fourth Degree if the assault is based on another person's actual or perceived race, color, religion, sex, sexual orientation, disability, age or national origin.

If you assault a school official while the school official is engaged in the performance of the official's duties and inflict demonstrable bodily harm, you could be guilty of Fourth Degree Assault.

5th agree assault

Fifth Degree Assault is defined as an act with the intent of causing fear in another of immediate bodily harm or death or a person intentionally inflicts or attempts to inflict bodily harm upon another.

A prior conviction for this type of offense can make a future conviction either a gross misdemeanor or even a felony.

Domestic assault

Minnesota provides that whoever commits an assault on a family or household member is guilty of domestic assault.

Prior convictions can make a new charge a gross misdemeanor or a felony. It may also prevent you from ever possessing a firearm under Minnesota law and Federal law.
